Note: If your reservation was made via AirBNB, Vrbo, or another 3rd party site, the rules set forth on that site will apply or overrule the terms below.
By confirming your reservation, you are confirming the receipt of and agreeing to the terms set forth below and/or on the site on which your reservation was made.
Read the VACATION RENTAL AGREEMENT TERMS AND CONDITIONS carefully before you pay a deposit and begin your vacation. Any monies received by WEATHERNABB RECREATION CO AND/OR BREAKAWAY ADVENTURES LLC (herein referred to as CABIN MANAGEMENT) for occupancy of the vacation property indicates acceptance of this VACATION RENTAL AGREEMENT TERMS AND CONDITIONS in full. All policies are strictly enforced.
RENTER REQUIREMENTS AND AGE RESTRICTIONS: For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit cardholder, who shall be referred to as “the Guest.” The Guest understands that the CABINS are only rented to responsible adults 23+ ONLY. Photo I.D. Required. Under no circumstances can any vacation property be reserved on behalf of a person under the age of 23. Whoever makes the reservation must be one of the occupants. Those staying with the Guest are the “Invitees.” It is the responsibility of the Guest and their invitees to be familiar with all policies pertaining to the vacation rental.
DOWN PAYMENT/ PAYMENT: A reservation will be guaranteed with a deposit paid when the reservation is confirmed. Full payment is due 30 days prior to the scheduled arrival date. Credit cards must have an expiration date that extends beyond the duration of the stay. If a reservation is made less than 30 days prior to arrival, full payment is due when the reservation is made.
STANDARD CANCELLATION POLICY: 100% refund at least 60 days before check-in. All but the deposit will be refunded 30-60 days before check-in. No refunds less than 30 days before arrival. Refunds may be charged a 3% processing fee depending on the payment system used. (Note: The option of a 3-day full refund policy during the off-season will be put in writing at time of reservation if applicable.)
RESERVATIONS IN ADVANCE: CABIN MANAGEMENT cannot guarantee availability on reservations for units if made 6+ months in advance. CABIN MANAGEMENT reserves the right to cancel a reservation under these circumstances: weather related conditions, late winterization without notification, reservations made against regulations such as maximum guests exceeded, length of stay, pet allowance, acts of nature, change in ownership or management, unexpected repair or maintenance, etc. If a reserved cabin becomes unavailable, CABIN MANAGEMENT will provide the Guest with a range of options which may include but are not limited to: Full refund, transfer to another unit for the same cost, date change, etc.
DAMAGE POLICY: The Guest will pay the cost of losses and damage sustained to the vacation property during their period of occupancy. The Guest shall disclose damage to the CABIN MANAGEMENT prior to check-out. Costs for damages will be charged to the credit card on file or billed to the Guest. CABIN MANAGEMENT is hereby granted the right to charge the Guest's credit card. An itemized statement outlining all associated costs will be sent via regular and/or electronic mail to the Guest’s address on file. Upon payment for reservations and checking into the property, the Guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.
CREDIT CARD AUTHORIZATION AND LIQUIDATED DAMAGES: The Guest certifies that they are the authorized holders of the credit/debit card provided for this reservation. The Guest explicitly authorizes CABIN MANAGEMENT to keep this card on file and to charge it, without further notice or additional signature, for any unpaid balances, township fines, association penalties, or incidental costs incurred during the stay.
Liquidated Damages for Specific Violations: The Guest agrees that certain violations cause damage that is difficult to estimate precisely. Therefore, the Guest agrees to pay the following pre-determined liquidated damages for these specific breaches:

Indoor Smoking Violation: A minimum of $250.00 for excessive cleaning and smoke remediation.

Unbagged/Unattended Pet Waste: $50.00 per incident for removal and sanitation.

Unauthorized Tree/Wood Cutting: A minimum of $100.00 per occurrence.

Holdover / Unauthorized Late Check-out: $35.00 per hour for every hour past 11:00 AM.
Property Damage Cap Authorization: For any physical damage to the structure, furnishings, or water equipment exceeding standard wear and tear, the Guest explicitly authorizes CABIN MANAGEMENT to immediately charge the card on file for the actual cost of repairs or replacement, up to a maximum pre-authorized amount of $1,500.00 per stay per cabin. An itemized receipt and statement of damages will be provided to the Guest within 14 days of the charge. Any damages exceeding this $1,500.00 cap will be billed directly to the Guest, and CABIN MANAGEMENT reserves the right to pursue further legal remedies to collect the remaining balance.
INSURANCE: The Guest and invitees are encouraged to review their own insurance policy to verify coverage for personal belongings brought and stored onsite to the vacation property. CABIN MANAGEMENT encourages the Guest and invitees to obtain vacation insurance to cover personal belongings.
UPON ARRIVAL: Look around the vacation property. If there are concerns or issues with the rental property, please immediately contact CABIN MANAGEMENT (leave a message or text if there is no answer). CABIN MANAGEMENT cannot offer consideration unless notified of issues.
FURNISHINGS: CABIN MANAGEMENT will provide bed linens, towels, and kitchenware. Please do not take the property's linens or towels outside. Bring your own outdoor towels and outdoor blankets. There is no daily cleaning of cabins during the stay. There is a laundromat nearby if the need arises. Do not use bleach on any linens or towels belonging to the cabin.
EMERGENCIES/ MAINTENANCE: If there are concerns or issues with the vacation rental property, please immediately contact CABIN MANAGEMENT (leave a message or text if there is no answer). CABIN MANAGEMENT will make every effort to return your call as soon as possible.
ARRIVAL & DEPARTURE TIME: Check-in is at 4:00 pm and check-out is at 10:00 am. In the months of June, July, and August CABIN MANAGEMENT will not grant an early check-in or late check-out. If you are staying outside of these months, please contact CABIN MANAGEMENT within 3 days of arrival to make these arrangements. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your scheduled check-in time. Your prompt departure prior to 10:00 am is appreciated so CABIN MANAGEMENT can prepare the property for any incoming guests. If you have not arranged for a late check-out, you may be charged $35 for each hour beyond 11:00 am you are still on property, at a minimum of one hour.
NO SMOKING: Smoking is NOT permitted in any vacation property. Smoking is allowed outside (at least 50 ft. away from any building). Discard the butts and ashes in the outside receptacles. Do not throw butts on the ground (including the fire ring) or bring them into the property. If there is any smell in the cabins after your departure, there will be a minimum $250 excessive cleaning and deodorizing treatment charge.
NOISE: Guests and/or music speakers must not disturb the peace, quiet, and comfort of the neighbors at any time with louder volume than is necessary for convenient hearing for the person or persons who are listening. North View Cabins (Denton Township) quiet hours are from 11:00 p.m. to 7:00 a.m. and West View Cabins quiet hours are from 10:00 p.m. to 8:00 a.m. During quiet hours, guests/speakers must not be audible from 50 feet away.
OCCUPANCY: Per township ordinance, special events and parties are not permitted. The number of guests onsite cannot exceed the maximum occupancy of the property.
PLUMBING: Only human waste and toilet paper are to be flushed. Do not put any feminine products, condoms, cigarette butts, tobacco products, paper towels, tissues, food, hair, diapers, grease or “flushable” wipes in the toilet. These items cause damage and clogging of the cabin sewer/septic system. Plungers are provided if a clog occurs. Please do not pour grease or food waste down any drain (no disposal).
FIREPIT: Do not put anything except wood or wood products in the firepit. Do not leave the property or leave a fire unattended. Campfires must be completely extinguished before going to bed. Where applicable, the size of the fire should be small enough so that embers are not landing outside the ring. Woodcutting from living trees around the property is not permitted, so bring your own kindling or fire starter with you. If it is found that any wood is cut, a minimum of $100 will be charged.
PETS: With a fee, CABIN MANAGEMENT can accommodate dogs. No cats or other pets allowed. North View Cabins allows two (2) dogs per cabin, under 50 pounds each. West View Cabins allows one (1) dog per cabin, under 50 pounds. The Guest must immediately bag dog waste and dispose of it in the outdoor trash receptacles; this is a health and safety requirement. Dog waste that is picked up on your behalf will be charged $50 per occurrence. To ensure a peaceful environment for all guests, do not allow your dogs to make excessive noise. Dogs must be leashed while outside and never left at the vacation property unattended. Dog accidents and damage indoors are the Guest’s responsibility, and additional cleaning fees may be charged for excessive dog messes.
VEHICLES AND TRAILERS: West View Parking is designated in the areas around the cabins, with a maximum of one (1) trailer and two (2) vehicles per cabin.
North View Cabins (Denton Township) short-term rental ordinance limits the number of vehicles allowed on-site:
- Cabin 1: 2 vehicles and 1 trailer
- Cabin 2: 1 vehicle and 1 trailer
- Cabin 3: 2 vehicles and 1 trailer
These limits include visitor parking and always apply. Please note that trailers cannot be replaced with additional vehicles. Street parking and parking outside of the property lines are prohibited so make sure your vehicles and trailers are within the boundaries. Offsite parking is available upon request. Guests are responsible for payment of tickets/fines related to improper parking.
LEFT ITEMS: Please check carefully for belongings before you leave. Left items can be mailed to you if requested and you will be charged shipping costs. CABIN MANAGEMENT is not responsible for lost or stolen items.
RIGHT OF ENTRY: The Guest agrees that CABIN MANAGEMENT reserves the right to enter the vacation rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate. Violations of township ordinances (e.g., maximum occupancy, quiet hours, illegal activities) will result in immediate termination of the agreement and eviction from the property without a refund.
SECURITY & SAFETY RISKS: When you rent the vacation property, you assume responsibility for it and its contents, as well as your personal property. Indoor candles, oil lamps and incense are not permitted indoors. Children are welcome, but there are conditions in and around the vacation property that may pose hazardous to them, as well as to adults, such as the lake, wildlife, icy surfaces and firepits. Children must be always supervised. CABIN MANAGEMENT does not assume any responsibility for injuries resulting from your failure to use due caution. Always lock doors and windows when leaving. When you leave, please shut off all lights, turn off the air conditioners/turn down the heat to 55 degrees. Please take all the garbage from the cabin and put it in the proper receptacle.
SHARED BEACH USE, WATER TOYS, BICYCLES, AND DISCLAIMER: The use of the waterfront beach, swimming area, dock, sea wall, water equipment, and mooring buoys is at the Guest and invitees’ own risk. No lifeguard is on duty. Use of kayaks, paddleboards, rafts, or floats is at the Guest and invitees’ own risk. ABSOLUTELY NO RUNNING ON, DIVING OFF, OR JUMPING OFF OF DOCKS IS PERMITTED! Do not take kayaks or paddleboards offsite. Return water equipment back to where it was found. Life jackets are provided to be used as required, but Guests and invitees are encouraged to bring their own life jackets to ensure proper fit. CABIN MANAGEMENT is not responsible for the misuse of any item left on the property for the use of the Guest and invitees. Guests and their invitees are responsible for knowing all the applicable laws while on or near the water. Those laws may be viewed at www.Michigan.gov/DNR.
At North View Cabins, the yellow platform is for lounging and sunbathing in the shallow swimming area only. Do not move it to deep water. Do not jump on/off, horseplay, or use the yellow platform for anything other than lounging.
At West View Cabins, there are bicycles available for guest and invitees use. The use of any bicycles brought onto or provided by the property is strictly at the Guest's and invitees' own risk. CABIN MANAGEMENT assumes no liability for personal injury, accidents, or property damage resulting from bicycle use. Bicycles must be stored outside in designated parking areas. Bicycles are strictly prohibited inside the cabins at any time. Guests and invitees must follow all local traffic laws and Michigan State regulations regarding bicycle safety, including the use of helmets where appropriate. Guests and invitees must provide and use their own helmets. Return bicycles back to their parking location when done riding.
WATERFRONT RESERVATIONS AND USE: At West View Cabins, the great lawn, two (2) firepits, dock, sitting areas, are Commons areas and can be used by all four (4) cabins. There is a map in the Guest Book at the vacation property for reference.
At North View Cabins, the seawall and lakefront lawn areas are reserved for Cabin 3 renters. There is one deck platform reserved for Cabin 1 and another platform reserved for Cabin 2. Guests’ outdoor gatherings must take place in the immediate vicinity of the Guest's own cabin or at the assigned deck platform. The area to the east of the arborvitae trees is a beach/landing area that can be used by all three (3) cabins. The dock and steps to swimming area may also be accessed by all three cabins. There is a map in the Guest Book at the vacation property for reference.
ORV RULES: Guests and their invitees are expected to review all applicable laws for primary roads, trail, and route systems. These may also be viewed at www.Michigan.gov/DNR. There is a free app called Polaris Ride Command that clearly identifies trails and routes so that Guests do not end up on a trail or route they are not supposed to be on.
WINTER CONDITIONS: We will attempt to have the driveway and walkways clear of snow before your arrival. A shovel is provided should you need it during your stay. Please be cautious when there are icy conditions.
Eviction Waiver Clause: The Guest acknowledges that this agreement does not create a landlord-tenant relationship. This is a transient vacation rental, and the Guest agrees to waive any right to a formal eviction process if they hold over past the designated check-out time.
Governing Law and Venue Clause: This agreement shall be governed by the laws of the State of Michigan. Any legal actions or disputes arising from this contract must be filed in the local court system of Roscommon (North View Cabins) or Otsego County (West View Cabins), Michigan.
INDEMNIFICATION & HOLD HARMLESS: While CABIN MANAGEMENT strives to maintain Vacation Properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All Guests and their invitees use the Vacation Property structures and premises at their own risk. CABIN MANAGEMENT shall not be held liable or otherwise responsible in any way for injury to any Guest and/or invitee that is caused or permitted to be caused by the intentional or unintentional acts of said Guest and/or invitee, or by the failure of structures, appliances, (including BBQ's) furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the Vacation Properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the Vacation Property and/or its contents. CABIN MANAGEMENT shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Vacation Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s) and invitees hereby agree to forever hold-harmless and indemnify CABIN MANAGEMENT from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the property. TO BE CLEAR, the GUEST is responsible for their own safety and that of others (invitees) whether on or off the property, and Guests are responsible for the actions of their invitees.
SEVERABILITY: If any provision of this Agreement or the Application thereof shall, for any reason and to any extent, be invalid or unenforceable, neither the remainder of this Agreement nor the application of the provision to other persons, entities or circumstances shall be affected thereby but instead shall be enforced to the maximum extent permitted by law.
BOOKING DETAILS: The specific cabin number, check-in/check-out dates, and total number of registered guests/pets are defined by and incorporated from the Guest's official booking confirmation.
